29 CFR 1910.95(c)(1):     The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:        (a)  On or about 9/11/12 - The Trim saw lead/stacker employee was exposed to continuous noise at 94.3% of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent level of  89.8 dBA.  The sampling was performed for 470 minutes during one shift.      (b)  On or about 9/11/12 - The Newman Trim saw feed employee was exposed to continuous noise at 197.7% of the allowable 8-hour time-weighted average sound level of 85.0 dBA or an equivalent level of 95.0 dBA.  The sampling was performed for 474 minutes during one shift.      (c)  On or about 9/11/12 - The MJ Saw feed employee was exposed to continuous noise at 118.4% of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent level of 91.3 dBA.  The sampling was performed for 477 minutes during one shift.      (d)  On or about 9/11/12 - The MJ Saw stacker employee was exposed to continuous noise at 134.1% of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent level of 92.3 dBA.  The sampling was performed for 470 minutes during one shift.

29 CFR 1910.178(p)(1):     Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition:    (a)  On or about 9/5/12, Production areas, the Caterpillar forklift, Model P5000 did not have a operable back-up alarm and the light bulb on the left rear side was out.    (b)  On or about 9/5/12, Production areas, the Caterpillar forklift, Model GD4PK had lights that were not operable on the right front and the left rear sides.

(b) On or about 9/4/12 - Conveyor at the Green trim saw, the rotating paddle style roller at the tail-end of the pulley was not guarded.
