29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. On or about September 5, 2012 on the south side of the construction site, an employee was engaged in framing activities on a residential building without fall protection. The employee was exposed to the hazard of falling approximately 21 feet to the ground below.

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided. On or about September 5, 2012 on the south side of the construction site, an employee was engaged in framing activities on a residential building. The employer did not provide an extension ladder where the employee could access and egress the upper landing safely.
