29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b) The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed on or about September 6, 2012, on the steep roof of a newly built house where employees were exposed to an 18 foot fall hazard when performing roofing work without a fall protection system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling when exposed to falls 6 feet or more above a lower level or ground.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: The employer does not ensure that portable ladders used for access to an upper landing are extended at least 3 feet above the upper landing surface accessed. a. This violation was observed on or about September 6, 2012, on the south side of a newly built house where employees were exposed to an approximately 18 foot fall hazard while using a 28 foot Louisville extension ladder to access the roof and the ladder was extended approximately 28 inches above the roof. b. This violation was observed on or about September 6, 2012, on the west side of a newly built house where employees were exposed to an approximately 18 foot fall hazard while using a 28 foot Werner extension ladder to access the roof and the ladder was extended approximately 12 inches above the roof. c. This violation was observed on or about September 6, 2012, on the north side of a newly built house where employees were exposed to an approximately 18 foot fall hazard while using a 28 foot Louisville extension ladder to access the roof and the ladder was extended approximately 28 inches above the roof. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that portable ladders used for access to an upper landing are extended at least 3 feet above the upper landing surface accessed.

This violation was observed on or about September 6, 2012, on the roof of a newly built house where employees were exposed to an approximately 18 foot fall hazard while using a metal extension to access the roof and the ladder was installed with the footing approximately 8 feet from the wall. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that portable ladders used for access to an upper landing are used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder.
