Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: HERACLES LOC 400, Garden City, TX: On or about March 12, 2012, the employer did not ensure that the rig's BOP (Blow Out Preventer), which had been recalled from the manufacturer, was operational and safe to use. The BOP(s) did not pass the function test.
