29 CFR 1910.147(c)(1):     Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    a.     On the site of the grain loading area where machines are serviced, the employer did not develop a lock out/tag out program which addresses specific machines and the type of energy control those machines thereby exposing nemployees to a contact hazard.

29 CFR 1910.178(l)(1)(ii):     Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).    a. 29 CFR 1910.219(c)(2)(i):     All exposed parts of horizontal shafting seven (7) feet or less from floor or working platform, excepting runways used exclusively for oiling, or running adjustments, shall be protected by a stationary casing enclosing shafting completely or by a trough enclosing sides and top or sides and bottom of shafting as location requires.      a.     In the yard beside the load out area, the Baldour Super E Motor had a shaft which was not properly guarded thereby exposing employees to a caught-in hazard.

On the site where product from corn was brought to the facility for shipment overseas, the employer did npt establish a frequency  schedule for removal of grain dust within tyhe facility thereby exposing employees to a fire/dust explosion.

29 CFR 1910.305(b)(1)(ii):     Unused openings in cabinets, boxes, and fittings shall be effectively closed.    a.     In the main electrical room where employees were turning on and off electrical equipment, the Cotler Hammer energized electrical panel box had four missing circuit breakers and the opening was covered by duct tape.    b.     In the main electrical room at the bottom of the Drag 1 conveyor, there was a unused opening at the bottom of the energized electrical disconnect thereby exposing employees to a contact hazard.

29 CFR 1910.1200(e)(1):     Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:    29 CFR 1910.1200(e)(1)(i):     A list of the hazardous chemicals known to be present using a product identifier that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,    a.     On the site the employer did not provide a training program for hazard communication and a list of cemicals known to be on site thereby exposing employees to a contact hazard.
