29 CFR 1926.201(a):     Signaling by flaggers and the use of flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices (MUTCD) Millennium Edition Section 6E.01 (Qualifications for Flaggers):    a)  Olney Ave. & Esterbrook Lane, Cherry Hill, NJ:  An employee was conducting traffic direction / flagging within the right of way of a public street with no Stop/Slow paddle or flag was exposed to traffic struck-by hazards.  The flagger had received no training in safe temporary traffic control practices.  As such the traffic was not properly controlled in accordance with the 2000 MUTCD Part VI CHAPTER 6E. FLAGGER CONTROL, Section 6E.01 Qualifications for Flaggers, Standard:  which states that a flagger shall be a person who provides temporary traffic control.  Because they are responsible for road user safety, and because they make frequent contact with the public, flaggers should have the following minimum qualifications:  Adequate training in safe temporary traffic control practices;     Observed on or about 09/07/2012.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.201(a):      Signaling by flaggers and the use of flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices (MUTCD) Millennium Edition Section 6E.04 (Flagger Procedures):    a)  Olney Ave. & Esterbrook Lane, Cherry Hill, NJ:  An employee was conducting traffic direction / flagging with no Stop/Slow paddle or flag and was exposed to struck-by hazards.  The temporary traffic control did not meet the standards mandated by the 2000 MUTCD Part VI CHAPTER 6E. FLAGGER CONTROL, 6E.04 Flagger Procedures, which establishes that Flagging shall be conducted with either paddles or flags.      Observed on or about 09/07/2012.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.200(g)(2):     Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (MUTCD), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA.    a)  Olney Ave. & Esterbrook Lane, Cherry Hill, NJ:  Advance warning signs were posted about the perimeter of the jobsite.  The legend of the warning signs had been modified by the employer with sliver duct sealing tape and card board.  As such the traffic was not properly controlled in accordance with MUTCD Part VI Section 6F.02 which states:  Warning signs in temporary traffic control zones shall have a black legend on an orange background.  Observed on or about 09/07/2012.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
