29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a. On or about September 6, 2012, an employee in the 14-foot 6-inch width by 30-foot 3-inch length by 5-foot 6-inch depth excavation tamped the backfill around storm drain OS-35 box at 5800 NW 34th street on the west side of the street, an was not protected from a cave in hazard by use of an adequate protective system or sloping.
