Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while being lifted in a forklift attachment:      a)  Employees were exposed to fall hazards while being elevated in a job-made bucket attachment of an all-terrain forklift.     Among other methods, feasible and acceptable means of abatement to correct this hazard include, but are not limited to the following:     (1)  Conform to the American National Standard Institute (ANSI) for Rough Terrain Forklift Trucks, ANSI/ITSDF B56.6-2005, Paragraph 5.15.1(a).     No abatement certification or documentation is required for this item.

29 CFR 1926.602(d):  The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):    29 CFR 1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a)  The employer did not ensure that the operator of the Ingersoll Rand all-terrain forklift was evaluated and competent to operate the powered industrial trucks.    No abatement certification or documentation is required for this item.
