29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used:    a) Jobsite, 356 McCandless Road, Arnold, PA: On or about August 29, 2012, during roofing activities, the employer did not ensure that a safe means of access to the ladder jack scaffold was provided. The employer had a ladder set up against the scaffolding for access, which extended approximately 1 1/2 feet, exposing employees to falls of approximately 15 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and trained each employee in the procedures to be followed in order to minimize these hazards:    a) Jobsite, 356 McCandless Road, Arnold, PA: On or about August 29, 2012, prior to engaging in roofing activities, the employer did not ensure that employees on the roof were provided with fall protection training in order to enable them to recognize fall hazards and educate them on the type and proper use of fall protection systems/devices. Employees working on an approximate 10 in 12 pitch roof were not using any fall protection and were exposed to falls of up to approximately 20 feet.

29 CFR 1926.20(b)(2): The employer did not ensure that programs existed that called for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers:    a) Jobsite, 356 McCandless Road, Arnold, PA: On or about August 29, 2012, prior to engaging in roofing activities, the employer did not ensure that a safety program was implemented at the job site. Deficiencies noted during the inspection included, but were not limited to the lack of fall protection being used at the job site while on a roof or a ladder jack scaffold, not ensuring that a safe means of access was provided on the scaffold and that no safety training had been provided for employees.
