29 CFR 1910.304(b)(2)(iii): The branch circuit wiring method did not include or provide an equipment grounding conductor to which the grounding contacts of the receptacle or cord could be connected:    a) North Dock, on or about 8/20/12, No equipment grounding conductor was installed at the galvanized steel light poles exposing employees to shock and burn hazards.     b) South dock, 120 Front St Newburgh, On or about 8/21/12, Extension cords were in use from the restaurant outdoor outlet to the dock with no ground pins.

29 CFR 1910.305(a)(2)(x):  Flexible cords and cables were not protected from accidental damage, as might be caused, for example, by sharp corners, projections, and doorways or other pinch points:    a) South Dock 120 Front Street Dock On or about 8/21/12, an extension cord was plugged into an outdoor outlet at the restaurant and run underneath a concrete sidewalk, to the dock exposing it to damage.    b) North Dock, 120 Front Street Dock On or about 8/21/12, The power cord was worn down to bare copper wire resulting in electrifying the poles exposing employees to shock hazards.

29 CFR 1910.333(a)(1): Safety-related work practices were not employed to prevent electric shock or other injuries resulting from either direct or indirect electrical contacts, in that:  Live parts to which an employee was exposed were not deenergized before the employee worked on or near them:      a) North Dock, The Torches on Hudson, on or about 8/20/2012:  Employees were exposed to shock hazards while troubleshooting and repairing dock lighting and did not take adequate precautions to ensure equipment was denergized prior to contact.
