The trench did not have a ladder or other safe means of egress, on or about September 11, 2012.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) Trench at West Side of Ganser Library Building - Employees worked in a trench 8 feet 4 inches deep, dug in Type C soil, to install condenser piping. The trench had sloping appropriate for protecting a trench dug in Type B soil because the competent person used only a visual test, rather than both a visual and manual test, to classify the soil, on or about September 11, 2012.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): (a) Trench at West Side of Ganser Library Building - Employees worked in a trench 8 feet 4 inches deep, dug in Type C soil, to install condenser piping. The trench did not have an adequate protective system in that the south wall of the trench had a slope with an angle of 44.8 degrees rather than 34 degrees required for Type C soil, on or about September 11, 2012.
