29 CFR 1926.1101(k)(1)(i): The employer did not identify TSI and sprayed or troweled on surfacing materials in buildings as asbestos-containing and did not determine in compliance with paragraph (k)(5) of this section that the material is or is not asbestos-containing. The employer did not identify vinyl flooring material installed later than 1980 to also be considered as asbestos containing and did not, pursuant to paragraph (g)(8)(i)(I) of this section determine that it is not asbestos-containing. On September 11, 2012, employees were found disturbing presumed asbestos containing material at the worksite and no asbestos survey was available showing if the materials were asbestos containing or non-asbestos containing.

29 CFR 1926.1101(k)(5)(iii) The employer did not demonstrate that flooring material including associated mastic and backing does not contain asbestos, by a determination of an industrial hygienist based upon recognized analytical techniques showing that the material is not ACM. On September 11, 2012, employees were found to be disturbing Presumed Asbestos Containing Material and flooring material and no determination had been made by an industrial hygienist that the material is not Asbestos Containing Material (ACM).
