29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: At the back of the showroom structure on or about September 10, 2012, eye protection was not worn while hammering and pulling nails out of scrap plywood with a claw hammer.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris, were not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures: At the back of the showroom structure on or about September 10, 2012, scrap lumber with nails was located on the ground all over the area. There was no area barricaded off for passageways.
