OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were:        A.)  J.R. Resources, L.P, --- Dora well site. - On or about 8/27/12, employee was potentially exposed to fall hazards, struck by, and caught-between hazards from being lifted in and working from the bucket of a backhoe.  The employer authorized the practice of employees being lifted in and working from the bucket to perform work activities.  Employees were lifted and worked approximately 5 feet above ground level in the bucket of Case backhoe (Series 2, Model #JJG0268324) to pump from the manhole/vent of the brine tank.      B.)  J.R. Resources, L.P. ---  James Snyder well site  On or about, 8/27/12, employee was potentially exposed to fall hazards, struck by, and caught between hazards from being lifted in and working from the bucket of a backhoe.  The employer authorized the practice of employees being lifted in and working from the bucket to perform work activities.  Employees were lifted and worked at heights of up to 8 feet above ground level in the bucket of the Case backhoe (Series #2, Model #JJG0268324 to remove a ladder and blow line from a brine tank.

29 CFR 1910.23(d)(1):     Every flight of stairs having four or more risers was not equipped with standard stair railings or standard handrails as specified in paragraphs (d)(1)(i) through (v) of this section, the width of the stair to be measured clear of all obstructions except handrails:      A.)  J.R. Resources, L.P., Dora well site - On or about, 8/27/12, employees were utilizing stairways to access the top of 8 foot high brine tanks.  One side of the stairway was completely open and was not equipped with any railings.  The side of the stairway that was equipped with a rail was only outfitted with a top-rail and was not equipped with a mid-rail.  The condition exposed personnel to a fall hazard of up to 8 feet.

Resources, L.P, Dora well site - On or about 8/27/12, the employer did not ensure the use of flame-retardant clothing (FRC) necessary to protect employees from burns due to potential flash fires.  Employees were not wearing/utilizing (FRC) to protect against flash fires and related burn injuries while performing tank draining.        B.)  J.R. Resources, L.P., James Snyder well site -  On or about 8/27/12 and on subsequent occasions, the employer did not ensure the use of flame-retardant clothing (FRC) necessary to protect employees from burns due to potential flash fires.  Employees were not wearing/utilizing (FRC) to protect against flash fires and related burn injuries while repairing natural gas leaks.    .
