29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b)  Note:  If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502.    a) Worksite, Southeast side roof - Employees installing shingles approximately 20 feet above the ground on the edge of an approximate 10 in 12 pitch residential roof, did not have fall protection; On or about 09/11/12.    Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.503(c): The employer did not retrain affected employees  who already had been trained but demonstrated inadequate  understanding and skill required by paragraph (a) of this section:    a) Worksite, Southeast side roof - Employees installing shingles approximately 20 feet above the ground on the edge of an approximate 10 in 12 pitch residential roof, did not have fall protection. The employees did not reconize the hazard and means to abate. The employees were not retrained; On or about 09/11/12.    Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    a) Worksite, East Side - Employees were using a ladder to gain access to a roof. The ladder was not secured and the side rails extended approximately 2 inches above the upper landing; on or about 09/11/12.    Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
