29 CFR 1910.1030(c)(1)(iv)(B): The annual review and update of the Exposure Control Plan did not include annual consideration and implementation of appropriate commercially available and effective safer medical devices designed to eliminate or minimize occupational exposure:    The Rocky Mountain Lions Eye Bank, at 1675 Aurora Court #E1-2049, Aurora, CO: On and preceding 9/11/12, The Rocky Mountain Lions Eye Bank did not ensure that the annual review and update of the Exposure Control Plan included annual consideration and implementation of appropriate commercially available and effective safer medical devices designed to eliminate or minimize occupational exposure.  Recovery technicians used BD 20mL Luer-Lok tip syringes with BD 16 gauge 1 1/2" non-safety needles to perform subclavian blood draws.  Recovery technicians deposited the drawn blood into handheld vacutainers.  Recovery technicians were exposed to contaminated needles during the blood draw and transfer of blood to the vacutainer.  Two needlesticks occurred in 2011 while using BD 20mL Luer-Lok tip syringes with BD 16 gauge 1 1/2" non-safety needles.  The employer did not consider and implement safer medical devices during its November 2011 annual review of safer medical devices.  This condition exposed employees to a bloodborne pathogen hazard.

Two cases for the year 2011 were recorded on the OSHA 300 log.  Both cases involved needlesticks.  The employer did not ensure that the employee names were removed from the OSHA 300 Log.

Employees harvested and processed corneas, sclera, and blood samples.  The employer offered hepatitis B vaccination to employees at time of hire.  The employer did not assure that approximately four employees, who declined to accept the hepatitis B vaccination offered at time of hire, signed a declination form.
