29 CFR 1926.652(d)(2): Manufactured materials and equipment used for protective systems were not used and maintained in a manner that was consistent with the recommendations of the manufacturer. Instance A.) On or about September 12, 2012 employees were working in a trench installing a sanitary sewer line with a trench box missing a pin in the cross brace exposing employees to a struck-by hazard. Instance B.) On or about September 12, 2012 employees were working in a trench installing a sanitary sewer line where the two stacked boxes were not pinned together exposing the employees to a struck-by hazard. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.652(g)(1)(iii): Employees were not protected from the hazard of cave-ins when entering or exiting the area protected by shields. On or about September 12, 2012 employees were traveling outside of the trench boxes to enter and exit a trench to install a sanitary sewer line exposing employees to the hazards associated with a trench collapse. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
