29 CFR 1926.20(b)(2)  Programs did not provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers:    Location: The St. Charles Boschertown Lift Station, 3400 N. Highway 94, St. Charles, MO 63301     On or about 8/27/12 the controlling employer failed to perform frequent and regular inspections by a competent person.  On or about 8/28/12 a fatality occurred when a subcontractor employee was assigned to coat pipes in an 18' 6" deep valve vault.  The following unsafe conditions occurred:            a)	Use of unsafe ladder rungs            b)	Misuse of a step ladder            c)	Lack of air monitoring prior to and during entry in a confined space            d)	Lack of attendant            e)	Lack of mechanical ventilation            f)	Lack of retrieval equipment            g)   Lack of respiratory protection

29 CFR 1926.21(b)(2)  The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    Location: The St. Charles Boschertown Lift Station, 3400 N. Highway 94, St. Charles, MO 63301.      On or about 8/27/12 the general contractor (controlling employer) failed to notify/instruct a subcontractor employee in the recognition and avoidance of unsafe condition(s) observed.   On or about 8/28/12 a fatality occurred when a subcontractor employee was assigned to coat pipes in an 18' 6" deep valve vault.        OR IN THE ALTERNATIVE:     29 CFR 1926.21(b)(6)(i)  Employees required to enter into confined or enclosed spaces were not instructed as to the nature of the hazards involved, the necessary precautions to be taken, and in the use of protective and emergency equipment required.  The employer did not comply with specific regulations that applied to work in dangerous or potentially dangerous areas:    Location: The St. Charles Boschertown Lift Station, 3400 N. Highway 94, St. Charles, MO 63301.      On or about 8/27/12 the general contractor (controlling employer) failed to notify/instruct a subcontractor employee in the recognition and avoidance of unsafe condition(s) observed.
