29 CFR 1910.146(c)(2):     The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces:    NOTE: A sign reading DANGER-PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign.    On or about August 15, 2012, Mor-Agra Grain Handling, Inc. employees entered the number 2 boot pit that was not designated as a permit required confined space.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.146(e)(1):     Before entry was authorized, the employer did not document the completion of measures required by 29 CFR 1910.146(d)(3) by preparing an entry permit:  Note:  Appendix D to 29 CFR 1910.146 presents examples of permits whose elements are considered to comply with these requirements.    On or about August 15, 2012, Mor-Agra Grain Handling, Inc. employees entered the number 2 pit boot without the completion of an entry permit that would document measures had been taken such as, but not limited to, testing the atmosphere to verify that a safe entry could be made into the work area.     Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.272(j)(1):     The employer did not develop and implement a written housekeeping program that established the frequency and the method(s) determined best to reduce accumulations of fugitive grain dust on ledges, floors, equipment, and other exposed surfaces.    Mor-Agra Grain Handling, Inc. permitted grain dust accumulation of in excess of .5 inches on the upper surfaces of post frame building wall girts in the dried distillers grain storage building, on electric conduits and electric equipment.      Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
