Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to being thrown from or pinned under, or crushed by a forklift by not wearing a seat belt.    (a)   Yard Area, on or about September 13, 2012, and at times prior thereto, employees operating the H28C Hyster were not required to wear a seat belt.    (b)   Yard Area, on or about September 13, 2012, and at times prior thereto, employees operating the H110 XL Hyster were not required to wear a seat belt and were observed not wearing the seat belt.     Note 1:  Among other methods, one feasible and acceptable method to correct this hazardous condition would be to require forklift operators, who operate powered industrial trucks to use provided seatbelts.  National consensus standard ANSI/ITSDF B56.1-2005, Section 7.41 requires the use of an operator restraint system when equipped on a powered industrial truck.     Note 2:  Abatement certification is required for this item.
