OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees (a) The employer did not ensure the Morse drum dumper "DD-09" was used in accordance with manufacturer's specifications in that this drum dumper was used to lift plastic drums when it was intended for steel drums. Employees were exposed to struck-by hazards from the plastic drums slipping out of the saddle.
