29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b) Note: If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502. The employer is failing to protect employees from potential fall hazards associated with re-roofing an existing residential apartment complex without fall protection. This was most recently evident during the inspection of the jobsite located at 2838 & 2842 Comstock Plz, Bellevue, NE 68123, where the employer has employees re-roofing an existing residential apartment complex where the ground to eave exceeds 25 and roof pitch is greater than 4:12 without fall protection.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: The employer failed to provide employees with fall protection training necessary to identify the hazards associated with re-roofing an existing residential apartment complex with a roof height over 6 ground to eave. The most recent example of this was found on the job site located at 2838 & 2842 Comstock Plz, Bellevue, NE 68123 where the employer had untrained and unprotected employees re-roofing an existing residential apartment complex with ground eave heights greater than 25 and roof pitch greater than 4:12 without having been trained on recognizing fall hazards.
