29 CFR 1926.102(a)(1):  Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents.    (a) 1033 Fairview Avenue, Staten Island N.Y: Employees were observed performing cutting operations without the use of eye and face protection.     Condition observed on or about September 17, 2012.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above the lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 29 CFR 1926.502(k) developed and implemented:    (a) On or about 09/17/2012 at 1033 Fairview Avenue, Ataten Island, N.Y: Employees were observed repairing roof joists on a 6/12 pitched roof with an eave heaight of approximately 20' to the ground with no fall protection in place exposing employees to fall hazards.

29 CFR 1926.1053(b)(1): Portable ladder was used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access. The portable ladder was not secured at its top to a rigid support, and a grasping device, such as a grabrail, was not provided to assist employees in mounting and dismounting the ladder.    (a) 1033 Fairview Avenue, Staten Island N.Y: On 9or about 9/17/12, the ladder provided was not secured and did not extend 3 feet above the working surface of the roof to allow for safe access on and off the roof.

29 CFR 1926.1053(b)(16):  Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired.    (a) On or about 09/17/2012 at 1033 Fairview Avenue, Staten Island N.Y: The Louisville 32' Extension Ladder used to access the roof had damaged footpads which were bent inward located at the base of the ladder. Employees accessing this ladder were exposed to fall hazards of approximately 20' to the ground below.
