29 CFR 1926.1052(b)(1): Where the treads and/or landings of pan stairs were to be filled in with concrete or other material at a later date, foot traffic was not prohibited on the stairway: On or about 9/13/12 at the Kronenberg Building rehabilitation project located at 12 Main Street, Hamburg, New York; employees were using unfilled pan stairs on the south side of the building to access the second floor. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge: On or about 9/13/12 at the Kronenberg Building rehabilitation project located at 12 Main Street, Hamburg, New York; employees were using unfilled pan stairs on the south side of the building to access the second floor. There was no handrail or stairrail in place. NO ABATEMENT CERTIFICATION REQUIRED
