29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) Schaefferstown, Pennsylvania - The employer allowed an employee to enter a six foot deep trench with a ladder that was located outside of the protective trench box, on or about September 10, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.652(e)(2)(i): Excavation of material to a level greater than 2 feet (.61m) below the bottom of the support system was allowed when there were indications while the trench was open to a possible loss of soil from behind or below the bottom of the support system. (a) Schaefferstown Pennsylvania - The employer allowed an employee to work inside of a trench where the excavation of material was three feet below the bottom of the support system, thereby exposing the employee to possible engulfment by unstable material on or about September 10, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

After that time the data may be stored off the jobsite, but a copy of the data shall be made available to the Secretary upon request.
