29 CFR 1910.178(l)(1)(i):     The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):      On or about September 12, 2012, at the jobsite an employee was observed operating a forklift truck without prior training or evaluation by a qualified person.  Employees were exposed to hazards caused by inexperienced forklift truck operator.

29 CFR 1926.451(c)(2)(v):     Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:      On or about September 12, 2012, employees were observed working from a platform made of a sheet of plywood mounted to a forklift truck and was raised to a height approximately 19 feet high.  The platform was observed not properly secured to the forklift truck.  Employees were exposed to fall hazards.

29 CFR 1926.451(g)(1):     Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level.      On or about September 12, 2012, an employee was observed working from a platform made of a sheet of plywood mounted onto a forklift truck and was raised to approximately 19 feet high without wearing a personal fall arrest harness.  The employee was exposed to fall hazards.

29 CFR 1926.602(c)(1)(ii):     Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:      On or about September 12, 2012, at the jobsite an employee was observed working from a platform made of a sheet of plywood which was mounted on an all-terrain forklift truck and raised to approximately 19 feet high.  The employer did not have a written approval from the forklift truck manufacturer to allow such addition/modification to the forklift.  Employees were exposed to fall and struck by hazards.
