29 CFR 1910.134(e)(1):     The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    (a) On one or more days during the summer of 2012, paper files and faxes were sent from the Mequon location to the Fox Point location of Premier Vision.  While assisting management in performance of this task, a worker was provided and permitted to use a tight-fitting 3M half face respirator equipped with N95/organic vapor cartridges.  However, before the worker used this type of respirator, there was no provision of a medical evaluation to determine the worker's fitness to use this respiratory protection equipment.

29 CFR 1910.1020(e)(2)(i)(A):     The employer did not, upon request, ensure each employee and designated representative access to employee exposure records, defined in 29 CFR 1910.1020(e)(2)(i)(A)(1)-(3) as relevant to employee exposure:    (a) Employees requesting access to reports of environmental studies conducted at the Mequon and Fox Point locations of Premier Vision were not provided access to the September 7, 2012 EH & E Report #18288, "Dust Characterization Results , Premier Vision, 10800 North Port Washington Road, Mequon, Wisconsin."  This report consisted of analyses of surface dust samples and visual observations in the office area, based on a March 16, 2012 site visit.  Dust samples were characterized with regard to the presence and concentration of glass fibers (fiber glass).  Some of the samples were positive for fiberglass, and the reported concentrations of fiberglass in samples collected from the Chart Storage Room ranged from trace amounts to 1%.
