29 CFR 1910.134(d)(1)(iii): The employer did not identify or evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminants chemical state and physical form:     (a) Villalobos Concrete, Inc. @ 17th Pl & I-225, Aurora, CO 80045: On and before 9/19/12, the employer did not evaluate the respiratory hazards associated with exposure to silica during concrete cutting. An employee used a Soff Cut GX-4200 concrete cutter, equipped with a 13.5in blade to cut expansion joints.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employees ability to use a respirator before the employee was required to use the respirator in the workplace:     (a) Villalobos Concrete, Inc. @ 17th Pl & I-225, Aurora, CO 80045: On 9/19/12, the employer did not provide medical evaluations prior to the issuance and subsequent usage of respirators by employees. An employee was required to wear a Moldex 2200 Series, N95 filtering face piece while cutting concrete with the Soff Cut GX-4200.

29 CFR 1910.134(f)(2):  Employees using tight-fitting facepiece respirators were not fit tested whenever a different respirator facepiece (size, style, model or make) was used:    (a) Villalobos Concrete, Inc. @ 17th Pl & I-225, Aurora, CO 80045: On 9/19/12, the employer did not ensure that fit tests were provided to employees prior to the required use of Moldex 2200 Series, N95, filtering face pieces. An employee was required to wear the filtering face piece while cutting concrete with the Soff Cut GX-4200.
