OSH ACT of 1970 Section (5)(a)(1):   Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazard:      a) 50 Harrison Ave. Kearny, NJ      The employer did not remove the dock plate from service for inspection or repair after an employee fell on the dock plate at Bay Door #23 on 09/08/2012.         Among other abatement methods, one feasible and acceptable method of abatement is to conduct an inspection or repair before reusing the dock plate; according to ANSI MH30.1- 2007, 5.4 Owner Responsibilities: 5.4.5 Dock leveling devices that are structurally damaged or have experienced a sudden loss of support while under load such as might occurred a transport vehicle is pulled out from under the dock leveling device, shall be removed from service, inspected by the manufacturers authorized representative, and repaired as needed before being placed back to service."        Violation was observed on or about 09/12/2012
