29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) Jobsite: 411 Smiley Street, TCM forklift - On or about 9/20/2012, employees were exposed to the hazards of operating a powered industrial fork truck that had been modified by the attachment of a trailer hitch ball to the fork without prior approval of the manufacturer. The modified industrial fork truck was used to move hitch mounted equipment at the work yard. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) Jobsite: 411 Smiley Street, TCM fork lift - On or about 9/20/2012, employees were exposed to the hazards of operating an industrial fork truck without the employer ensuring the employees were competent to operate the powered industrial truck. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
