29 CFR 1926.300(c):     Employees who used hand and power tools and were exposed to the hazard of falling, flying, abrasive, and splashing objects, or exposed to harmful dusts, fumes, mists, vapors, or gases were not provided with the particular personal protective equipment necessary to protect them from the hazard:    On or about September 20, 2012, the employer did not ensure that employee(s) exposed to the hazards of flying brick chips and silica dust particles, while cutting bricks dry, were provided respirators and safety spectacles with unperforated sideshields. Employee(s) were exposed to the hazard of being struck in eye and inhalation hazards.

29 CFR 1910.1200(h)(1):     Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)    On or about September 20, 2012, the employer did not ensure that employees exposed to the hazards of silica and dust particles, while cutting bricks without water, were provided effective information and training on hazardous chemicals in their work area at the time of their initial training. This condition exposed employee(s) to inhalation hazards associated with exposure to airborne silica and dust particles.
