29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. a) Meadowlark Drive, on or about 9/19/2012, The site foreman was in an excavation with accumulated water from heavy rain the day before. Adequate lateral shoring was not provided to safeguard the employee from being crushed by the road plate and the concrete structure.

29 CFR 1926.404(b)(1)(ii): On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure and which are in use by employees did not have approved ground fault circuit interrupers for personal protection. a) Meadowlark Drive, Cohoes, NY, on or about 9/19/2012; the water pump used to empty the excavation was plugged into an EG3500X Honda generator that was not protected by a Ground Fault Circuit Interrupter (GFCI). Carver Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard; 29 CFR 1926.404(b)(1)(ii), which was contained in OSHA inspection number313763138, citation number 1, item number 1 and was affirmed as a final order on (10/06/2011), with respect to a workplace located at Richmond Ave. Hoosick Falls, NY 12090.
