29 CFR 1926.501(b) (13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented. This violation occurred on September 21, 2012, at the single family home located at 401 Fairweather Street in Desoto, Texas 75115, where at least one (1) employee was framing a two-story residence, working from the top of the home's walls, without fall protection. The employee was exposed to a fall hazard of more than 9-feet to the ground below.

29 CFR 1926.1051(a): A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided. This violation occurred on September 21, 2012, where at least one (1) employee, performing framing work, was not provided with a ladder, climbed the single family home's interior framing creating a break in elevation of approximately 28-inches.
