Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with operation of stump cutters. On or about 9/20/2012, 27670 Water Street: A Vermeer 502 Stump Cutter was in use without its wheels being chocked to prevent movement. Among other methods, a feasible abatement method to correct this hazard is to comply with American National Standard Institute (ANSI) Z133.1 - 2006 Safety Requirements for Arboricultural Operations. Including, but not limited to: 1) Ensuring that all employees are instructed in the proper use, inspection, and maintenance of tools and equipment, and ensure that appropriate working practices be followed as referenced in Section 3.1.2. 2) Ensure that towed units are chocked or otherwise secured in place as referenced in 5.1.17. Abatement documentation is required for this item.

29 CFR 1910.132(d)(2): The employer did not verify, through a written certification, the identity of the workplace evaluated, the person certifying that the evaluation had been performed, and the date the hazard assessment was done: On or about 9/20/2012, 27670 Water Street: Employees were required to use PPE such as, but not limited to eye protection, head protection, hand protection and cutting chaps. The employer had not provided a written certification that a hazard assessment for PPE was performed. Abatement certification is required for this item.
