The condition was noted on or about 09/21/12. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1910.1048(m)(5): The employer did not develop, implement, and maintain at the workplace, a written hazard communication program for formaldehyde exposures in the workplace: a) Facility wide - Employees performing the keratin hair treatment are exposed to formaldehyde which is contained in INOVA Professional Hair Smoothing treatment and Ultra Hair Smoothing treatment which were found to contain 2.1 % and 3.6% formaldehyde respectively. The employer failed to develop and implement a written hazard communication program for formaldehyde. The condition was noted on or about 09/21/12. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
