29 CFR 1910.22(c): "Covers and guardrails." Covers and/or guardrails shall be provided to protect personnel from the hazards of open pits, tanks, vats, ditches, etc. Vertical Mill Area - On or about September 17, 2012, the employer failed to provide a cover and or guardrail to protect employees from falling into an open pit in the vertical mill area that measured 60 inches deep, thereby exposing employees to fall hazards.

The following items shall be inspected for defects at intervals as defined in paragraph (j)(1)(ii) of this section or as specifically indicated, including observation during operation for any defects which might appear between regular inspections. All deficiencies such as listed shall be carefully examined and determination made as to whether they constitute a safety hazard: Throughout facility - On or about September 17, 2012, the employer had not performed frequent inspections on P & H 20 ton, Whiting 10 ton, Abell -Howe 1/2 ton crane or any other cranes, thereby exposing employees to struck by hazards.

Complete inspections of the crane shall be performed at intervals as generally defined in paragraph (j)(1)(ii)(b) of this section, depending upon its activity, severity of service, and environment, or as specifically indicated below. These inspections shall include the requirements of paragraph (j)(2) of this section and in addition, the following items. Any deficiencies such as listed shall be carefully examined and determination made as to whether they constitute a safety hazard: Throughout facility - On or about September 17, 2012, the employer had not performed periodic inspections on P & H 20 ton, Whiting 10 ton, Abell -Howe 1/2 ton crane or any other operating cranes, thereby exposing employees to struck by hazards.
