29 CFR 1926.501(b)(3): Each employee in a hoist area was not protected from falling 6 feet (1.8 m) or more to lower levels by guardrail systems or personal fall arrest systems: (a) Second Floor of Gym Area Renovation - Employees removed the top rail in a 17-foot long wooden section of the guardrail system along the eastern edge of the second floor to unload tools hoisted up to the second floor on the forks of a JCB Loadall telescoping handler. The employees did not use personal fall arrest equipment while working in this hoist area, on or about September 21, 2012.

29 CFR 1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structural members shall be installed between the top edge of the guardrail system and the walking/working surface when there is no wall or parapet wall at least 21 inches (53 cm) high: (a) Second Floor of Gym Area Renovation - Employee worked on the second floor, staging equipment in preparation for cutting holes in some concrete block walls to make door way openings. A section of the guardrail system, 17 feet long, along the eastern edge of the second floor had a top rail but no mid rail, on or about September 21, 2012.
