29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) Heritage Group Homes, 2000 Southwestern Drive, West Ellicott, NY., employee observed operating Lull/Highlander Powered Industrial Truck, Model 644B-34, without being trained in the proper use of such equipment as evidenced by the observation of the employee climbing down the mast of the lift head first to gain access to the cab of the lift so the controls could be operated and the employee working from the pallet attached to the forks could be lowered to the ground safely.    ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.178(m)(2): Persons were allowed to stand or pass under the elevated portion of trucks, either loaded or empty:    a) Heritage Group Homes, 2000 Southwestern Drive, West Ellicott, NY., employee observed working from the pallet of shingles placed on the forks of the Lull/Highlander Powered Industrial Truck. The forks were raised and the employee had one foot on the forks and the other one on the roof. The employee was exposed to falls of approximately 12 feet to the ground below. 29 CFR 1910.178(m)(5)(iii):When the operator of an industrial truck was dismounted and within 25 feet of the truck still in his view, the load engaging means were not fully lowered, controls neutralized, and the brakes set to prevent movement:    a) Heritage Group Homes, 2000 Southwestern Drive, West Ellicott, NY., employee observed working from the pallet of shingles placed on the forks of the Lull/Highlander Powered Industrial Truck. The forks were raised and the employee had one foot on the forks and the other one on the roof. The forks were not lowered and the controls neutralized on the equipment. The employee was exposed to falls of approximately 12 feet to the ground below.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) Heritage Group Homes, 2000 Southwestern Drive, West Ellicott, NY., two (2) employees were observed working on a 5 x 12 piched roof without any type of fall protection being utilized by either employee.
