29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: At 5656 McClelland Drive, Baton Rouge, LA (Autumn Place project); the employer failed to provide a means of egress for an employee working inside a trench excavation. This condition was determined on or about September 12, 2012, where an employee was standing upright and taking measurements inside an excavation with a depth of 4 feet 6 inches without a having a ladder or other a safe means of egress.

29 CFR 1926.651(f): A warning system such as barricades, hand or mechanical signals, or stop logs was not utilized when mobile equipment was operated adjacent to an excavation, when such equipment was required to approach the edge of an excavation: At 5656 McClelland Drive, Baton Rouge, LA (Autumn Place project); the employer failed to provide a warning system when an excavator was being operated near the trench opening. This condition occurred on or about September 12, 2012, where a Kubota KX121-3 compact excavator was being operated at the edge of an excavation where an employee working from without the work area being barricaded off or having other warning systems in place.
