29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  (Construction Reference 1926.103):    At 5656 McClelland Drive, Baton Rouge, LA (Autumn Place project); the employer failed to provide employees with information contained in Appendix D of the respirator standard.  This condition was determined on or about September 12, 2012, where employees provided MSA N95 particulate respirators (for voluntary use) when performing brick masonry work, were not given basic advisory information on respirators.

29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)    At 5656 McClelland Drive, Baton Rouge, LA (Autumn Place project); the employer did not have a written hazard communication program for employees using hazardous chemical products in the workplace. This condition was determined on or about September 12, 2012, where employees performing brick masonry work were exposed to chemical products such as LaFarge Masons Mortar Mix containing hazardous ingredients such as, but not limited to, crystalline silica, Portland cement, calcium sulfate, and calcium carbonate.
