29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about 09/24/2012, the employer diud not ensure that employees working from a lift platform on the back of the company truck at the Brothers Fuel Mart were using some type of fall protection. Employees were observed working from a loft platform, 13.5 ft above cement pavement, without any type of fall protection.

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted. On or about 09/24/2012, the employer did not ensure that employees working on top of a sheet metal canopy over gas pumps at the Brothers Fuel Mart, were using some type of fall protection. Employees were working approx. 14 ft above cement pavement without fall protection.
