The violation occurred on or about 08/20/2012 on Manhattan Blvd, where the mployer did  not provide advance warning to road users that the right travel lane was closed for mobile refueling operations of heavy equipment. There was no indication to road users what action they must take to drive through the work zone thereby exposing the refueling operator to struck-by hazards.

29 CFR 1926.200(g)(2)/MUTCD Section 6C-26: All traffic control signs or devices used for protection of construction workers do not conform to Part VI of the Manual of Uniform Traffic Control Devices ("MUTCD"), 1988 Edition, Revision 3, September 3, 1993, or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, in that the employer did not channelize traffic when redirecting the driver's path was required..     On or about 08/20/2012, the employer did not ensure that employees were protected from being struck by vehicular traffic while performing mobile refueling operations. At approx. 0700 hrs, an employee was in a mobile work zone in the right lane of Manhattan Blvd between Gretna Blvd and the Westbank Expressway in Harvey LA. The employee was refueling heavy equipment that was parked at various locations along the right side of the roadway.  Channelization devices (i.e. traffic cones) were not in use in the transition zone behind the fuel truck to alert drivers on the roadway to move to the adjacent (left) lane.
