29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment:    a)  Backyard, 2 Constitution Blvd, Berlin, NJ - Employees not using appropriate personal protective equipment were exposed to numerous hazards, such as:  eye injuries, amputation, serious head injury, were involved in the cutting down and removal of an approximate 35-40 foot high tree with an approximate 18-24 inch trunk, on or about 09/25/12.         NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.133(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.    a)  Backyard 2 Constitution Blvd, Berlin, NJ - Employee without eye protection was using a chain saw to cut down a tree, on or about 09/25/12;    b)  Backyard 2 Constitution Blvd, Berlin, NJ - Employees without eye protection were using a chainsaws to cut up sections of the tree and raking up previously cut branches, on or about 09/25/12.         NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

Employers shall select and require employees to use appropriate hand protection when employees' hands are exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasions; punctures; chemical burns; thermal burns; and harmful temperature extremes.    a)  Backyard, 2 Constitution Blvd, Berlin, NJ - Employees without any hand protection were using Stihl and Husqvarna chainsaws to cut down and cut up an approximate 30-40 foot high tree with an approximate 18-44 inch diameter trunk, on or about 09/25/12.         NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
