29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means: JOBSITE: The employee, engaged in removing roofing insulation (task) utilizing a hand-held knife from a mobile scaffold was allowed not only to position himself, but also the scaffold in close proximity of the overhead electrical wiring that had damaged electrical conduit and exposed electrical live wiring.

29 CFR 1926.416(a)(3): Before work began, the employer did not ascertain by inquiry, direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, was so located that the performance of the work could bring any person, tool, or machine into physical or electrical contact with the electric power circuit. JOBSITE: The employer did not ascertain, prior to commencing the "work", through inquiry, direct observation, instruments and/or other means that the overhead electrical wiring that had damaged electrical conduit and exposed live electrical wiring was located in close proximity of the work area and ensure through job briefing, instruction and visual observation that the employee, engaged in removing roof insulation utilizing a hand-held knife from a mobile scaffold was appropriately protected from coming in contact with the wiring while performing the above task.
