OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Instance 1: On or about 09/24/2012, in the work areas to the east of the building/establishment and to the west of Mire Highway, the employer did not ensure that employees were protected from struck-by hazards which resulted from vehicular traffic, including public traffic, construction vehicles, and construction equipment. Instance 2: On or about 09/24/2012, in the work areas to the east of the building/establishment and to the west of Mire Highway, the employer did not ensure that employees whose views of oncoming vehicular traffic were obstructed due to the nature of the work they performed were protected from struck-by hazards that resulted from vehicular traffic, including public traffic, construction vehicles, and construction equipment. Among other methods, one feasible and acceptable abatement method would be to ensure that employees exposed to struck-by hazards presented by vehicular traffic wear a reflective vest, and additionally, those employees whose views of oncoming vehicular traffic are obstructed are guarded by a physical barrier or shield.
