29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) Windsor Locks Safety Complex, 4 Volunteer Drive - On or about - 9-24-12 - Employee was killed when a wooden grade stake used to support the tailgate broke while the victim was in the danger zone between the spill plate and the tailgate of the dump truck body.

29 CFR 1926.301(a): Unsafe hand tool(s) were issued or permitted to be used: a) 4 Volunteer Drive, Windsor Locks, Ct. - On or about 9-24-12 - Employees were provided and permitted to use wooden grade stakes to hold the tail gate of dump trucks open for the purpose of cleaning the spill plate and bottom of the tail gate while performing paving operations. This practice exposed employees to struck-by hazards.
