OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards from falling materials. Employees working in the East Production Building were exposed to crushing injuries from falling materials being hoisted from unapproved wire rope slings. Wire mesh panels were being hoisted with shop made fabricated wire rope slings with the following defects: 1. Wire rope clips were used to fabricate wire rope slings; 2. Crosby clips were not spaced and torqued per manufacturers recommendations; 3. Wire rope slings were not proof tested and identified.
