29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:      a) Various locations on the roof:  On September 25, 2012 and at times prior thereto, workers performed roofing activities on a 6 in 12 pitched roof with fall protection harnesses worn but not attached to lanyards or anchor points.  Workers were exposed to fall hazards ranging from 10 to 20 feet to the ground and concrete driveway below.      Note) Abatement certification and documentation ARE required for this item.

29 CFR 1926.503(a)(2)(iii):     The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:    a) Residential jobsite: On September 25, 2012 and at times prior thereto workers and the responsible person on site did not acknowledge, and take minimum actions to correct the hazard created by not properly setting up and wearing the fall protection system that was available.
