Section 5(a)(1): The employer failed to furnish to each of his employees employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm, in that employees were exposed to struck-by and explosion hazards from an uncontrolled release of gas and oil: (a) On or about September 23, 2012, for three employees that were injured from a well blow out where the company failed to maintain positive well control at all times at well number 22-15-HB, 1/2 mile north of the junction of Highways 73 and 22, Mandaree, ND. Among other means, one feasible and acceptable means of abatement would be for the employer to follow the guidelines established by the American Petroleum Institute Recommended Practice 54 Section 6.1.1 (Operations) "Where well control shall be maintained at all times. Consideration shall be made to ensure appropriate equipment and materials are on location and operational before work commences."
