OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees struck by vehicular traffic. a) Colonial Road, Franklin Lakes, NJ: Employee engaged in flagger duties was exposed to struck by hazards while working in a flagger station that was not illuminated at night, as required by Section 6E.08 of the MUTCD 2009Edition, on or about 09/18/2012. b) Colonial Road, Franklin Lakes, NJ: Employees engaged in storm related clean-up activities were exposed to struck by hazards while working on a roadway, without the proper use of signs that conform to Section 6E:08 and 6G.03 of the MUTCD 2009Edition, on or about 09/18/2012.
